ORDER

This writ petition has been filed challenging the notice issued by the fifth respondent calling for the petitioner to attend enquiry to be held on 27.08.2024.

It is seen that the said notice was issued in pursuant to the direction issued by this Court in WP.No.2759 of 2024 dated 18.06.2024. The said writ petition was filed challenging the order passed by the first respondent dated 02.02.2024, thereby cancelled the cheque signing power of the petitioner. This Court after setting aside the said order passed by the first respondent, directed the first respondent to hold enquiry by giving notice to the petitioner and to pass detailed order after giving opportunity of hearing to the petitioner on or before 30.09.2024. However, the notice impugned in this writ petition has been issued by the fifth respondent. Therefore, the notice was not issued in consonance with 2/4

the order passed by this Court and on this sole ground, the notice issued by the fifth respondent cannot be sustained and the same is liable to be quashed.

Accordingly, the impugned notice dated 19.08.2024 of the fifth respondent is quashed. The first respondent is directed to comply with the order passed by this Court in WP.no.2759 of 2024 dated 18.06.2024 in letter and spirit.

With the above direction, this writ petition stands allowed. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
