PRAYER: Writ petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarifed Mandamus to call for the records relating to the order of the 3rd respondent dated 01.10.2016 in Na.Ka.No.5608/2016/A2 and quash the same and consequently direct the respondents to forthwith include the name of the petitioner in Electoral Roll of the Part 66 of the 6th Ward of Nasiannor Town Panchayat.

ORDER

By the impugned order, the request of the petitioner to include his name in the voters list was rejected, as it was filed belatedly.

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents.

3. The learned counsel for the petitioner submitted that the petitioner is ready to approach the 3rd respondent with a fresh application and the same may be considered.

4. The learned Additional Government Pleader appearing for the respondents submitted that the petitioner gave a petition to include his name, just one week prior to the local body election. Hence, the petition was rejected and if the petitioner give a fresh representation to the 3rd respondent, the same will be considered in accordance with law.

5. In the light of the submissions, this writ petition is disposed of, with a direction to the petitioner to give fresh representation to the 3rd respondent, by enclosing a copy of this order. On such compliance, the 3rd respondent shall pass orders afresh, on merits and in accordance with law, within a period of twelve weeks therefrom, after providing opportunity to the necessary parties. No costs. Consequently, connected miscellaneous petitions are closed.
