The petitioner/accused apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 465, 468, 471 IPC which was registered in T.Palur Police Station in Crime No.210 of 2023, seeks anticipatory bail.

The case of prosecution is that one L.Ravi, Training Sub Inspector of Police had lodged this complaint as against the petitioner stating that on 14.08.2023, he received an information suspecting a car bearing Regn.No.TN07 CF 6531 nearby T.Palur Co-operative Society Bank and on enquiry by the complainant, it was informed that the petitioner had left the car three days before and thereafter, the complainant went to the house of the petitioner and enquired him to show the RC Book and she had given the RC Book for Regn.No.TN05 BJ 4276. When the complainant searched through vehicle, it was found that the registration number belongs to Hasarudeen Ali 1/4
S/o Anwar belonging to RN Palayam, Vellore District. Therefore, he enquired him and Hasarudeen replied that he is having his vehicle.
3. The learned counsel for the petitioner submitted that he is innocent and he is no way connected to the offence.

The learned Government Advocate (Crl.side) would contend that based upon the counter submitted that the petitioner/accused is history sheeted rowdy in H.S.No.232/2011 dated 26.05.20211 on the file of T.Palur Police Station. The petitioner/accused is also involved in the following previous cases - Srl.No.

5. Heard the learned counsel for the petitioners as well as Government Advocate (Crl.side) and perused the records. 2/4

Admittedly, the car was parked in front of the house of the accused and on investigation, it came to light that the RC Book given by the petitioner's wife is different from the number plate found in the car. During investigation, it was found that he purchased the car in the hypothecation and to conceal the car, he has changed the number plate of the said car and used the same by using other car number. The car which belong to the accused is TN05 BJ 4276. He has removed the number plate of the car and used the car with duplicate number plate TN07 CF 6531 in order to escape from the hypothecation bank.

Considering the over tact, the modus operandi adopted by the petitioner and the fact that the investigation is in the preliminary stage, I am not inclined to grant anticipatory bail to the petitioner for the present, with a liberty to file fresh application after passage of time or change in circumstances.
8. Accordingly, this Criminal Original Petition is dismissed. rgr 3/4
