ORDER
(The Order of the Court was made by P.Velmurugan, J) This Writ Petition is filed praying for issuance of a Writ of Certiorarified Mandamus to call for the records connected with impugned order dated 24.06.2025 passed by the second respondent and quash the same and direct the respondents to grant emergency leave for 15 days without escort to the detenue, Gemini Mohammed, S/o Nagoor Ghani, aged about 35 years, bearing Convict No.10356 (PID.No.289092), confined at Central Prison-I, Puzhal.
2. The petitioner has challenged the said order dated 24.06.2025 passed by the second respondent, whereby, the representation for 15 days emergency leave of the detenue, was rejected on the ground that the detenue is not entitled for emergency leave for more that 12 days, but the detenue has sought for leave of 15 days and therefore, the detenue is not entitled for emergency leave. However, the Probationary Officer has also done field verification and the reason mentioned in the representation is false. The petitioner has also not produced 2 / 4
any medical records/medical certificate to show that she has annexed the medical certificate for emergency leave of the detenue Gemini Mohammed, S/o Nagoor Ghani.
3. In the above circumstances, this Court does not find any perversity in the impugned order passed by the second respondent. Accordingly, this Writ Petition is dismissed. However, the petitioner, who is the mother of the detenue Gemini Mohammed, S/o Nagoor Ghani, is at liberty to file fresh application with medical leave before the Prison Authority and seek necessary leave, within the norms as per the Tamil Nadu Prison Manual.
