ORDER
The petitioner, who had been arrayed as an accused in Crime No.135 of 2019, was granted bail on certain conditions by the learned Principal Sessions Judge, Salem on 28.08.2019 in C.M.P.No.2706 of 2019. Seeking to modify the same, the present petition had been filed.
2. Heard Mr.M.R.Franklin, learned counsel appearing for the petitioner and Mr.C.Iyyapparaj, learned Additional Public Prosecutor appearing for the respondent.
3. The learned counsel for the petitioner submitted that the petitioner will co-operate for the early disposal of the complaint and will appear before the Court below during all the hearing dates.
4. Taking into consideration the facts and circumstances of the case, this Court is of the considered view that the Court below ought not to have imposed such an onerous condition and accordingly, the Condition No.3 in the order of the Trial Court https://hcservices.ecourts.gov.in/hcservices/
in C.M.P.No.2706 of 2019, dated 28.08.2019, shall stand modified to read as follows:
3) that the petitioner shall report before the respondent Police daily at 10.00 AM for a minimum period of 30 days for interrogation and on further condition that he shall appear before the respondent Police as and when required by the Investigation Officer thereafter.
All other observations made in the earlier order dated 28.08.2019 in C.M.P.No.2706 of 2019 shall remain intact.
5. This Criminal Original Petition stands ordered accordingly.
