ORDER : The Court Made the following order :- The petitioners who were arrested and remanded to judicial custody on 27.11.2021 for the offence under Sections 6 (4) of TNSC (RDCS) Order 1982 r/w 7 (i) a(ii) of E.C. Act, 1955, in Crime No.175 of 2021, on the file of the respondent police, seek bail.
2. The case of the prosecution is that on 23.11.2021 the petitioners along with others illegally transported the 22000 Kgs of PDS rice by using lorry. Hence the complaint.
3. The learned counsel for the petitioners would submit that they have been falsely implicated in this case and that they have been suffering incarceration for more than 20 days from 27.11.2021. He would pray for grant of bail to the petitioners. https://hcservices.ecourts.gov.in/hcservices/
4. The learned Government Advocate (Crl. Side) raised objection stating that the petitioners illegally transported the 22,000 kgs PDS rice worth about RS.1,25,000/- . Hence, he vehemently opposed to grant bail to the petitioners.
5. Taking into consideration of the quantity of PDS rice involved in this case, this Court is not inclined to grant anticipatory bail to the petitioner.
