ORDER

The Writ Petition is filed for the following relief: "directing the 1 st respondent to take immediate action on the Statutory petition filed by the petitioners on 28.04.2025 under Maintenance and welfare of Parents and Senior citizens Act, 2007".

2. The brief facts which are culminated in the filing of this Writ Petition are set out below:

2.1 The petitioners who are senior citizens had filed the petition before the 1 st Respondent who is the statutory Authority under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, (herein after called the Act). They had approached the 1 st Respondent as they had been abandoned by their only daughter and son-in-law who had been arrayed as Respondents 2 and 3 herein.

2.2 It is their contention that the petitioners had spent a huge sum of money in purchasing and developing the property in the name of Respondents 2 and 3 at a total cost of over 1.5 crores, which has been enjoyed by their daughter. They had also spent money for the education, upbringing and household needs of the Respondents 2 and 3 and their children. They further submitted that they helped the 3 rd Respondent, their son-in-law to purchase a property at Bangalore with a fond hope that they could be taken care of by their daughter, 2 nd Respondent. The Petitioner's contention is that even after the 2 nd Petitioner had undergone surgeries, the 2 nd Respondent did not extend any help

and support though she had received enormous financial assistance from the petitioners herein.

3. Since their daughter had abdicated her responsibility, the petitioner had moved the 1 st Respondent by filing the statutory petition under the Act. Though this petition was filed on 28.04.2025, to date no enquiry has been proceeded. Since the 1 st Respondent who is the competent Authority had failed to perform his duty, the petitioners have moved this Court.

4. Heard the learned Counsel for the Petitioners and Mr.R.Murthy, the learned Government Advocate for 1 st Respondent.

5. Taking into account the fact that the petitioners only seeks early disposal of the statutory petition filed by them, in which Respondents 2 and 3 are Respondents, this Court had proceeded to pass orders without issuing notice to Respondents 2 and 3. This Court is only issuing direction to 1 st Respondent to dispose of the Statutory petition within a period of three (3) months after

hearing the petitioners as well as the Respondents 2 and 3 herein.

6. With the above directions, Writ Petition is disposed of. Consequently, connected miscellaneous petitions are closed.
