Respondents PRAYER: Writ Petition is filed under Article 226 of Constitution of India praying to issue Writ of Certiorarified Mandamus to call for the records on the file of the 4th respondent in Na.Ka No.13-4/2023 dated 07.02.2023 and quash the same, further direct the respondents to issue certificate to treat the certified copies of the following documents as original the 1) Sale deed in Doc. No.3898/1999 on the file of the Kodambakkam Sub Registrar Office, Chennai, 2)Sale deed in Doc.No.2020/1994 3)Sale deed in Doc. No.1271/1998 on the file of the Kelamangalam Sub Registrar Office, Krishnagiri, 4)Sale deed in Doc.no.466/1994 on the file of the Hosur Sub Registrar Office, Krishnagiri, 5)Settlement Deed in favour of S.Gowri, W/o.G.Naraimhalu in Doc.No.4049/2014 on the file of the Hosur Sub Registrar Office, Krishnagiri.

O R D E R
The relief sought for in the present writ petition is to quash the order passed by the 4th respondent in Na.Ka No.13-4/2023 dated 07.02.2023 and to direct the respondents to issue certificate to treat the certified copies of the documents as original 2.The petitioner states that he purchased lands in Krishnagiri and Chennai Districts. The petitioner rented out a room of the flat that belongs to him to a third party. He kept his documents in the said room in the flat and after sometime, the petitioner found that the original parent documents of the properties were eaten by termites. The petitioner approached the respective Sub Registrar Office to procure the certified copies of the Sale deeds and Settlement deeds.
3.Admittedly, the respective Sub Registrar have already issued the certified copies in compliance with the request of the Writ Petitioner. Thereafter, the Writ Petitioner submitted an application requesting the Sub 3/6
Registrar to certify that the certified copies issued are the original documents. Such a certificate cannot be issued by the Sub Registrar which is beyond the scope of his power conferred under the Registration Act. The Sub Registrars are empowered to issue certified copies by verifying the original records available in the office of the Sub Registrar. However, the certified copies cannot be equated with the originals but the said certified copy may be used in alternate to the original. 4.This being the factum, the request of the petitioner to issue certificate treating the certificate copies as original was rightly rejected by the Sub Registrar and there is no infirmity as such. 5.Accordingly, the Writ Petition stands dismissed.
