ORDER
This writ petition has been filed for issue of writ of mandamus directing the respondents to act upon the representation made by the petitioner on 09.07.2025, wherein the petitioner is seeking for removal and shifting of the electricity pole erected in the front side of the petitioner's property.
2. When the matter is taken up for hearing, the learned Standing Counsel appearing on behalf of the respondents produced the written instructions received from the Assistant Engineer, Gummidipoondi. On going through the same, it is seen that the application submitted by the petitioner has been acted upon and the location to which the electricity pole was sought to be shifted has been identified. The necessary undertaking affidavit was also collected from the petitioner. However, when the electricity pole was attempted to be shifted, an Page No.2 of 5
objection was made by a private person stating that she is the owner of the property. Hence, the respondents were not able to proceed further.
3. The learned counsel for the petitioner submitted that there is an unobjectionable portion to which this electricity pole can be shifted and the petitioner has also shown this property to the respondents.
4. In light of the specific stand taken by the petitioner, there shall be a direction to the respondents to consider, as to whether this electricity pole can be shifted to the unobjectionable portion pointed out by the petitioner. If feasible, the entire process can be completed. Otherwise, the petitioner will have to necessarily obtain a No Objection Certificate (NOC) from the person objecting to the erection of the electricity pole in the already identified location. 5. In result, this writ petition stands disposed of in the above terms. No costs.
