This Criminal Original Petition has been filed to direct the respondent police to register the complaint of the petitioner dated 02.05.2022 and investigate the same in pursuance of the order in Crl.M.P.No.50 of 2022 dated 05.08.2022 passed by the Special Judicial Magistrate, Special Court for Exclusive Trial of Land Grabbing Cases, Cuddalore.

2. The learned counsel for the petitioner would submit that despite the order of the learned Special Judicial Magistrate, Special Court for Exclusive Trial of Land Grabbing Cases, Cuddalore in Crl.M.P.No.50 of 2022 dated 05.08.2022 passed under Section 156(3) of Cr.P.C to investigate the case and register the FIR if it is necessary, the respondent police has not registered the case. Hence, the present petition has been filed. 3.The learned Government Advocate (crl.side) for the respondent would submit that as per the order of the learned Special Judicial Magistrate, Special Court for Exclusive Trial of Land Grabbing Cases, Cuddalore in Crl.M.P.No.50 of 2022 dated 05.08.2022, enquiry has been conducted by the respondent police and the same has been closed as mistake of fact and 2/4

forwarded to the learned Magistrate. He would submit that RCS notice also served to the petitioner.

4. Recording the same, this Criminal Original Petition stands closed with liberty to the petitioner to approach the concerned Judicial Magistrate for appropriate remedy.
