ORDER

The petitioner has come forward with this petition seeking for a direction directing the respondents to alter the FIR in Crime No.216 of 2012 by including an offence under Sections 326, 307 and 506(ii) of IPC along with original offences and to file a final report in the manner known to law in a stipulated time that may be fixed by this Court.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. When the matter was taken up for hearing on 28.03.2016, it was represented by the learned Additional Public Prosecutor that in this matter, already referred charge sheet has been https://hcservices.ecourts.gov.in/hcservices/

filed in RCS No.11/12 and hence, a report has been called for from the learned Judicial Magistrate No.II, Dharmapuri.

4. As per the direction of this Court dated 28.03.2016, the learned Judicial Magistrate No.II, Dharmapuri, has sent a report, in which, it is stated that in Crime No.216/2012, under Sections 294(b), 323, 324 IPC, the Krishnapuram Police has filed RCS No.11/12 on 14.03.2016 in which notice in D.No.979/16, dated 05.04.2016 has been sent to the de facto complainant for her appearance to file her objections on 27.04.2016.

5. Recording the same, this Criminal Original Petition is disposed of. The petitioner has every right to approach the Court by filing protest application.
