By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. 2/6
2. The present writ petition is filed praying for a writ of Mandamus to conduct and dispose the appeal dated 14.11.2023 preferred by the petitioner.
3. It is submitted by the learned counsel for petitioner that the petitioner was aggrieved by the order dated 05.10.2023 of the 1st respondent whereby petitioner's request for issuance of patta was rejected. Aggrieved, petitioner preferred an appeal. It is stated that the appeal is pending for more than 11⁄2 years. It is requested that there may be a direction to dispose of the appeal within a stipulated time frame.
4. At the outset, it is submitted by Mr.S.Balamurugan, learned Government Advocate for respondents that they would consider the appeal filed by the petitioner and pass appropriate orders in accordance with law after affording a reasonable opportunity of hearing to the petitioner and other interested parties. Agreed to by the learned counsel for petitioner.
5. In view thereof, the writ petition stands disposed of with a direction to the respondents to consider the appeal filed by the petitioner and pass appropriate orders in accordance with law after affording a reasonable opportunity of hearing to the petitioner and other interested parties within a period of 10 weeks from the 3/6
date of uploading of web copy without waiting for the receipt of certified copy. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law.
