When the matter was taken up for hearing today, the learned counsel for the petitioner represented that since the ex-parte decree was set aside and E.P was terminated, the present revision petition challenging the E.P will become infructuous and also made endorsement to that effect. However, the learned counsel for the petitioner sought for permission to withdraw the amount which was deposited as per the order of this Court for a sum of Rs.93,572/-. 2. The respondent has not raised any objections.

3. Recording the said submission, this Civil Revision Petition is dismissed as infructuous as nothing survives for further adjudication. The petitioner is at liberty to withdraw the amount deposited before the trial Court. No costs.
