THE HONOURABLE Dr. JUSTICE G.JAYACHANDRAN Jayaprakash @ Kutta ... Petitioner Vs.

State Rep.by:

The Inspector of Police, Manali New Town Police Station, Thiruvallur District.

(Crime No.139 of 2022) ... Respondent PRAYER : Criminal Original Petition filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, to enlarge the Petitioner on bail in S.C No.537 of 2024 on the file of the Additional District & Session Court-IV at Ponneri. For Petitioner :

Mr.P.Chandrasekar For Respondent :

Mr.A.Gopinath Government Advocate (Crl.side)

O R D E R

The petitioner herein, who is an accused in S.C No.537 of 2024 pending on the file of the Additional District & Session Court-IV, Ponneri, had jumped bail 1/4

on 30.06.2024. He was secured on execution of Non-Bailable Warrant after an order dated 02.07.2025. He seeks for bail stating that he is in prison for more than 30 days.

2.

The learned Government Advocate (Crl.Side) appearing for the respondent police opposed the grant of bail to the petitioner and submitted that the petitioner had earlier jumped bail and remained absconding for a long period. He further submitted that if released on bail, the petitioner may once again abscond. The trial has been delayed due to the petitioner's absence, thereby affecting the rights of co-accused, who have been regularly appearing before the Court. 3.

Considering the conduct of the petitioner, the seriousness of the violation of bail conditions and the objection raised by the learned Government Advocate (Crl.Side), this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed for the present. 01.09.2025 rpl To 1.The Additional District & Session Court-IV, Ponneri. 2/4

2.The Inspector of Police, Manali New Town Police Station, Thiruvallur District.
