This Writ Petition has been filed for a direction to the respondents 3 and 4 to permit the petitioners to participate in the Peace Committee Meeting and also in the festival that is going to be conducted on 03.09.2023 in the temple and also direct the respondents to keep the gold jewellery belonging to the deity in a locker at any nationalised bank and to hand over the keys to the petitioners.

When the matter came up for hearing on 30.08.2023, the learned Senior Counsel appearing on behalf of the petitioners submitted that in the Peace Committee Meeting that was held before the Tahsildar, two resolutions were passed. By virtue of the first resolution, the first petitioner was included as one of the nattar for the temple and it was also agreed by the others. The learned Senior Counsel submitted that the grievance is with regard to the second resolution that was passed in the Peace Committee Meeting where there was absolutely no clarity as to where the jewellery belonging to the deity is going to be kept. In the light of this submission, the learned Additional Public Prosecutor was directed to take instructions and report before this Court and the matter was posted for hearing today. 3/7
3. The learned Additional Public Prosecutor submitted that there is a locker that is available in the adjacent building and jewellery will be kept in that locker and the keys can be kept under the custody of any official as directed by this Court.
4. The function is going to be held on 03.09.2023. Therefore, as a temporary measure, the jewellery shall be kept in the locker that is located in the adjacent building and the keys shall be handed over to the seventh respondent namely, the Joint Commissioner of H.R & C.E., Department. After the completion of the festival, the seventh respondent shall take a decision for the safe custody of the jewellery and the person in whose control the keys will be handed over. A representation in this regard shall be made by the petitioners before the seventh respondent after the completion of the function.
5. This Writ Petition is disposed off in the above terms. No costs. Consequently, connected miscellaneous petitions are closed. 01.09.2023 4/7
