ORDER
The above writ petition is filed for issuance of a writ of mandamus, directing the 1st respondent to dispose of the Second Appeal dated 07.02.2025, sent to the 1 st respondent by the petitioner by registered post, within a stipulated time fixed by this Hon'ble Court.
2. The petitioner submitted an application under Section 8 of the Right to Information Act, 2005, to the 3 rd respondent on 14.10.2024, seeking certain information relating to action taken in furtherance to the compliant made by his son dated 22.09.2017. On 28.10.2024, the 3 rd respondent declined to furnish the information sought for by the petitioner. The petitioner, hence, preferred an appeal under Section 19(1) to the 2 nd respondent on 20.11.2024. However, the nd respondent, vide his letter dated 13.12.2024, refused to provide information sought by the petitioner. Therefore, the petitioner preferred a Second Appeal on 07.02.2025, to the 1 st respondent. However, no action was taken in the Second Appeal. The petitioner, therefore, filed the above writ petition for the aforesaid 2/5
relief.
3. The learned counsel for the 1 st respondent submitted that the petitioner's Second Appeal is numbered as S.A.No.2845, and that the same is pending and sought reasonable time to dispose of the Second Appeal.
4. Heard both sides and perused the materials available on record. With the consent of both the learned counsels, the main writ petition is takenup for final disposal.
5. Under the facts and circumstances of the case, and in view of the submission of the learned counsel for the 1 st respondent, a direction is issued to the 1 st respondent, to dispose of the Second Appeal preferred by the petitioner within a period of eight (8) weeks from the date of receipt of a copy of this order. Writ petition is accordingly disposed of. However, there shall be no order as to costs.
