Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the 1st respondent to issue Patta in the petitioner's name in respect of the property in S.No.24/2, total extent 10 cents and S.No.24/4, total extent 9 cents, situated at Voimedu West Village, Vedaranyam Taluk, Nagapattinam District by considering the petitioner's Appeal dated 24.07.2024.

ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The relief sought in this writ petition is to direct the 1st respondent to issue Patta in the petitioner's name in respect of the property comprised in S.No.24/2 measuring an extent of 10 cents and S.No.24/4, measuring an extent of 9 cents situated at Voimedu West Village, Vedaranyam Taluk, Nagapattinam District by considering the petitioner's Appeal dated 24.07.2024.

The learned counsel for the petitioner submitted that the petitioner preferred an Appeal dated 24.07.2024 before the 1st respondent seeking to set aside the Proceedings dated 30.06.2023 bearing Na.Ka.No.2343/2023/Aa5 issued by 3rd respondent and to grant Patta in favour of petitioner, Mrs.Elavarasi (petitioner's sister) and Mrs.Kalaiselvi 2/5

(petitioner's mother) in respect of the aforesaid property, but, the said Appeal has been pending before the 1st respondent for more than one year.

4. At the outset, the learned Special Government Pleader appearing for the respondents submitted that the petitioner's Appeal dated 24.07.2024 would be disposed of by the 1st respondent, within a time frame to be fixed by this Court.

5. The above submission made by the learned Special Government Pleader for the respondents has been fairly conceded by the learned counsel for the petitioner.

6. In view thereof, this Court, without expressing any opinion on the merits of the case, directs the 1st respondent to dispose of the petitioner's Appeal dated 24.07.2024 and pass appropriate orders, on merits and in accordance with law, after issuing notice and affording a reasonable opportunity of hearing to the petitioner, Mrs.Elavarasi (petitioner's sister), Mrs.Kalaiselvi (petitioner's mother) and all other interested parties including rival claimants, if any, within a period of twelve weeks from the date of 3/5

uploading of the web copy of this order without waiting for the receipt of a certified copy of this order.

7. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
