PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus forbearing the 3rd respondent from registering any documents in respect of the agricultural lands with an extent of 5 1/6
acres situated at S.No.80/1, in extent of 5 acres situated at 80/2, measuring an extent of 10 acres situated at 84/1A and 84/1B, Thazhambur Village, without considering the protest petition dated 11.07.2024 registered as Document No.PP/Thiruporur/75/2024 in the office of the SRO, Thazhambur, the 3rd respondent herein.

ORDER
By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. In view of the order that this Court proposes to pass and also the limited relief that is sought to be granted, notice to respondents 4 and 5 is dispensed with.

The present writ petition is filed praying for a writ of Mandamus forbearing the 3rd respondent from registering any documents in respect of the agricultural lands comprised in S.Nos.80/1, 84/1A, 84/1B situated at Thazhambur Village, without considering the protest petition dated 11.07.2024 registered as Document No.PP/Thiruporur/75/2024 in the office of the SRO, Thazhambur.

It is submitted by Mr.N.L.Raja, learned Senior Advocate for petitioner that there is an interim order passed by the Metropolitan Magistrate, Saidapet restraining alienation of properties jointly held by petitioner and her husband/ 4th respondent herein. It is further submitted that petitioner filed a protest petiton before the 3rd respondent. The limited prayer is that before any registration of properties in possession of petitioner and her husband is made, the protest petition may be considered. Agreed to by the learned Special Government Pleader for respondents.

To which, the learned Special Government Pleader appearing for the respondents would submit that if any document is presented for registration in respect of the subject property, the respondent authority would consider the protest petition submitted by the petitioner and thereafter proceed to register the document in accordance with law after issuing notice and reasonable opportunity of hearing to the petitioner, respondents 4 and 5 and other interested parties.
5. In view thereof, writ petition stands disposed of. It is open to the petitioner to submit any document including judicial orders in support of the protest petition. If any document is presented for registration in respect of the 3/6
subject property, the third respondent shall consider the protest petition along with any other material that is submitted by the petitioner after furnishing copies of the same to respondents 4, 5 and any other interested party and thereafter proceed to register the document in accordance with law.
