ORDER

This is in conjunction with and in continuation of earlier proceedings made on 01.11.2022.

2.As per the direction issued by this Court on 01.11.2022 in Crl.OP.No.25416 of 2022, report dated 08.11.2022 has been received from the learned Presiding Officer/Additional Chief Metropolitan Magistrate, Chennai.

3.It is seen from the report that the said Court is over burdened with huge pendency of cases, in specific, there are 14 cases pending for more than 15 years and 10 cases pending for more than 10 years. Normally, in CBI cases, the witnesses ranged from 30 to 185. After the present Presiding Officer took over charge, she is keen interested in conducting and disposing of cases, without much delay. With regard to C.C.No.5061 of 2012, out of 75 witnesses, so far 03 witnesses have been examined, of whom, PW3 had turned hostile, PW1 and PW2 are yet to be cross examined 2/4

by the Petitioner/defense side, despite their appearance before the Court below. The Presiding Officer requested minimum of six months time to conclude the trial.

4.The explanation given by the Presiding Officer seems to be reasonable. In view of the same, this Court disposes of this Criminal Original Petition with a direction to the learned Additional Chief Metropolitan Magistrate, Chennai, to complete the trial in C.C.No.5061 of 2016, within a reasonable time as early as possible. 15.11.2022 Internet : Yes/No Index : Yes/No Speaking Order/Non-Speaking Order sai To 1.The learned Additional Chief Metropolitan Magistrate, Egmore, Chennai.
