PRAYER: Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, to direct the third respondent to survey and fix boundary stones, in order to make fencing around the petitioner's property comprised in Survey No. 233/4B situate at Periasoragai Revenue Village, Tharamangalam, Salem with the help of the fourth respondent within a reasonable time as fixed by this Court.

O R D E R

The petitioner herein seeks a direction to 3rd respondent to survey his properties situated in Survey No.233/4B at Periasoragai Revenue Village, Tharamangalam, Salem with the help of 4th respondent.

2. According to the petitioner, he submitted an online application on 06.07.2024 seeking survey of the above mentioned land. Since the 5th respondent resisting the survey of the property, the petitioner also sought for assistance of 4th respondent to survey the land in question. A perusal of EChallan issued to the petitioner would indicate that petitioner also paid necessary survey charges.

3. Mr.P.Sathish, learned Additional Government Pleader, takes notice for the respondents 1 to 3 and Mr.S.Sugendran, learned Additional Public Prosecutor takes notice for the 4th respondent.

4. The learned Additional Government Pleader, who is taking notice for the respondents 1 to 3, submitted that the online application of the petitioner will be considered on its' own merits within a time fixed by this Court.

5. In view of the same, this Court, without going into the merits of the claim made by the petitioner, is inclined to direct the 3rd respondent to consider the online application of the petitioner dated 06.07.2024 and pass final orders on its' own merits within a period of eight weeks from the date of receipt of copy of this order after issuing necessary notice to the 5th respondent.
