By consent, the writ petition is taken up for final disposal at the admission stage itself.
The writ petition is filed to direct the third respondent to consider the claim of the petitioner for promotion as Special Sub-Inspector on par with his batch mates.
The case of the petitioner is that, he was falsely implicated in the criminal case in Cr.No.77 of 2015 for the alleged offence u/s. 147, 323, 294(b), 306 IPC and later it was altered as under Section 364 (A), 347, 384, 294(b), 355, 323 & 306 IPC and subsequently, he was issued with a charge memo and imposed with punishment of dismissal from service. Challenging the said punishment, the petitioner has filed W.P.No.29968 of 2018, wherein this Court by an order dated 20.10.2021, set aside the same. Pursuant to the order of this Court, the punishment was modified into "postponement of increment for a period of three years and the period of postponement shall not operate his future increments" vide proceedings dated 10.02.2022. The main grievance of the petitioner is that, during the pendency of criminal case,
his promotion has been deferred. Now, the criminal case ended in acquittal on 31.08.2023 and the departmental proceedings also ended with minor punishment. Hence, the petitioner has sent a representation to the third respondent dated 07.05.2025, to consider him for promotion and the same is pending.

Learned Special Government Pleader appearing on behalf of the respondents would fairly submit that, the petitioner's representation will be considered on merits and in accordance with law within a reasonable time. 5.
In view of the fair submission made by the learned Special Government Pleader, without going into the merits of the matter, this Court deems it appropriate to direct the 3rd respondent to consider the petitioner's representation dated 07.05.2025, and pass orders on it's own merits and in accordance with law within a period of eight (8) weeks from the date of receipt of a copy of this order.

In the result, the Writ Petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petitions are closed.
