O R D E R
The petitioner, who arrested and remanded to judicial custody on 10.06.2025, for an offence punishable under Section 302 of I.P.C., in Crime No.71 of 2023, registered on the file of the respondent, seeks bail.
2. The petitioner herein was secured on execution of a NonBailable Warrant (NBW) in S.C. No.65 of 2024.
3. According to the prosecution, the petitioner was not present on the date of hearing in the above case when it was posted on 18.03.2024. Hence, an NBW was issued and the petitioner was secured only on 10.06.2025 on execution of the said warrant.

The Learned Counsel appearing for the petitioner states that the petitioner was arrested in a detained case under Act 14 of 1982 on 01.02.2024 and released only on 23.11.2024, pursuant to the order passed by this Court in H.C.P. Therefore, he was not able to attend the Court on 08.03.2024 and subsequent dates.

5. Today, the learned Government Advocate (Crl. Side) appearing for the respondent circulated a letter from the Jail Superintendent, Central Prison, Vellore, wherein it is stated that the petitioner was detained under the Goondas Act on 01.02.2024 and remained in prison till 23.11.2024.
6. Considering the report from the prison authorities, this Court finds that the non-appearance of the petitioner in S.C. No.65 of 2024 was due to his preventive detention. Hence, this Court is inclined to grant bail, subject to certain conditions.
7. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum to the satisfaction of the learned X Additional Judge, Chennai.
[a] The sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;
[c] The petitioner shall report before the Judicial 3/6
Magistrate on every Monday at 10.30 a.m until further orders.
[d] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioners in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];
[e] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 21.08.2025 bsm To 1.The X Additional Judge, Chennai
