This Original Petition has been filed taking advantage of Section 372 of the Indian Succession Act, 1925 seeking Succession Certificate with respect to the securities in the name of Morarji Khimji Kenia, the late husband of the petitioner and the father of the 1st and 2nd respondents, who died intestate died on 20.07.2017. The details of the securities had been given in the schedule to the petition. They are primarily share in Neelamalai Agro Industries Limited.

2.After following due procedure, the petitioner was invited to tender evidence. Accordingly, the petitioner was examined as PW-1 and she marked Exs.P1 to P10. The documents include the Death Certificate and Legal Heirship Certificate of her husband, Morarji Khimji Kenia and the documents relating to the share certificates were marked as Exs.P1 to P6. The documents relating to the accounts statement of the hold of her husband in Union Bank of India account was marked as Ex.P9.

smv 3.In view of the evidence adduced, this Original Petition stands allowed. The Succession Certificate may be issued in favour of the petitioner in accordance with the rules.
