The suit has been filed for infringing of copyright in the year 2019 before this Commercial Division. The sole defendant has also been served and had also entered appearance through his counsel. 2.On the previous occasion, when the case was listed on 10.10.2022, this application was taken up for hearing. This Court was pleased to adjourn the case. The sole defendant has right to cross-examine the plaintiff witness and therefore this Court was inclined to give further opportunity to the sole defendant for cross examination.

3.Today when the case was taken up for hearing, there is no representation on behalf of the sole defendant. The name of the counsel for the sole defendant is printed in the cause list. C.SARAVANAN, J.

A.No.4455 of 2022 jas 4.I have perused the affidavit filed in support of the applications namely Appl.No.4455 of 2022 and O.A.No.369 of 2019. 5.Considering the fact that the suit itself is ready for trial before the learned Additional Master No.III under the caption before "un-defendant". I am inclined to allow this application in Appl.No.4455 of 2022. 6.In view of the order passed in A.No.4455 of 2022, no further order is required in O.A.No.369 of 2019.
