Writ Petition filed under Article 226 of the Constitution of India praying to issue a writ of mandamus to direct the second respondent to consider the representation submitted by the petitioner dated 28.05.2019 and to pass appropriate orders in accordance with the Rules within a reasonable period as may be fixed by this Hon'ble Court and to pass any other appropriate order or direction as this Hon'ble Court may deem fit and proper in the circumstances of the case and render justice. As per the request, the Writ Petition is taken up for final disposal at the admission stage itself.

The learned counsel appearing for the petitioner would submit that the petitioner was working as Senior Lecturer (Civil) in the Government Polytechnic College at Nagercoil has submitted representation to the Director of Technical Education to consider the petitioner for the post of upgraded Head of Department when the second respondent has accorded sanction in his proceedings dated 09.08.2010. proceedings dated 09.08.2010 has appointed one M.Selvaraj, Senior Lecturer in the Government Polytechnic College, Tuticorin has upgraded Head of the Department, on completion of 10 years of service as on 17.10.2009. Hence, the petitioner has also requested the second respondent to consider his name for upgradation as Head of the Department on 22.10.2009 itself. The second respondent in proceedings dated 29.04.2019 have also revised the seniority of certain Lecturers but the name of the petitioner has not been found place in the said proceedings in spite of the fact that the initial appointment of the petitioner was on 15.02.1988 along with one S.Raja Arumuga Nayanar, whose name has been in the said seniority list against seniority No.18. Therefore, the petitioner made a representation dated 28.05.2019, but till date his representation was not considered by the 2nd respondent. Aggrieved by the same, the petitioner has filed the above writ petition.

The learned counsel for the petitioner would further submit that it would be suffice to issue a direction to the respondents to dispose of the representation in accordance with law.

Without expressing any opinion, I am inclined to issue direction to the respondents to consider the petitioner's representation dated 28.05.2019 and dispose of the same in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order. With the above direction, the Writ Petition is disposed of. No costs.
