The petitioner who apprehend arrest at the hands of the respondent police for the offence punishable under Section 279, 353 and 328 of I.P.C and 24(1) of Cigarette and Other Tobacco Products Act, 2003, in Crime No.399 of 2023 on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that on 02.07.2023, when the respondent police has received a information from the Sub-Inspector of Police who was patrolling and checking the vehicle. At around 10.00 a.m., Ashok Leyland Grill cage Lorry bearing registration No.TN 85 L 8199 was stopped and checked there was no person in the said lorry. When it was suspiciously opened and sniffed it was found that it contained tobacco products. Hence the complaint.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prayed for grant of bail to the petitioner. 4.Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner herein is the owner of the lorry and one similar case is pending against him. Hence, he opposed for grant of bail to the petitioner.

6.Taking into consideration the nature and gravity of the offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
