Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the respondent to pay interest @ 10% for the belated payment of Gratuity, P.F., and Leave Salary to the petitioner.

ORDER

This Writ Petition is filed for issuance of a writ of mandamus, directing the respondent to pay interest at 10% per annum for the belated payment of Gratuity, P.F., and Leave Salary to the petitioner.

2. The case of the petitioner is that he joined the service of the respondent Corporation as Junior Assistant Trainee on 09.03.1990 and after rendering 33 years of service, retired from service on 30.06.2023, on attaining the age of superannuation. However, terminal benefits have been paid to him with much delay and interest for the belated period has not been paid. In this regard, he submitted a representation to the respondent on 03.06.2025, requesting to pay interest for the belated payment. However, no action has been taken by the respondent. Hence, he has come before this Court by way of this Writ Petition.

3. Learned Standing Counsel, appearing for the respondent, would submit that terminal benefits have been settled to the petitioner, but with some delay.

4. In view of the above, the respondent is directed to pay interest at 6% per annum for the belated period of payment of terminal benefits to the petitioner within a period of six weeks from the date of receipt of copy of this order. It is made clear that if the amount is not paid within the time frame

fixed by this Court, it will fetch interest at the rate of 9% per annum from the date on which the amount became due and payable till the date of realisation..

5. Writ Petition is disposed of accordingly. No costs. 22.09.2025 NCC :
