Respondents Writ petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of mandamus directing the respondents herein to allot the newly constructed shops in the Kadathur Bus Stand by the respondents 3 and 4 by conducting public auction strictly in accordance with Rule 3 of the Tamil Nadu Panchayat(Procedure for Conducting Public Auction of Lease and Sales in Panchayat) Rules 2001.

ORDER

Alleging that the shops are likely to be allotted without conducting public auction, the present writ petition has been filed seeking direction to that effect.

2. When the writ petition is taken up for hearing, the learned Government Advocate appearing for the respondents would submit that no allotment would be made to the third party without conducting public auction.

3. Recording the said statement, the writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is also dismissed.
