Crl.O.P.No.20229 of 2023 G.CHANDRASEKHARAN.J., The petitioner namely Nagaraj, who was arrested and remanded to judicial custody on 21.08.2023 for the offences punishable under Sections 4(1)(a) read with Section 4(1-A) of TNP Act in Crime No.271 of 2023 on the file of the respondent police, seeks bail.

The learned counsel for the petitioner submitted that, petitioner is innocent and he is falsely implicated in this case registered in Crime No. 271 of 2023 for the offences under Sections 4(1)(a) read with Section 4(1-A) of TNP Act. Petitioner is in Judicial Custody from 21.08.2023. Thus, he seeks bail to the petitioner.

In response, learned Additional Public Prosecutor submitted that, on 21.08.2023 at about 10 hrs., based on the secret information, defacto complainant along with police party mounted surveillance near Chinnatti Bus Stop. They found accused person in a suspicious circumstances. On seeing the police party, he tried to escape. However, respondent police apprehended him. On search, he was found in illegal possession of 52 bottles of brandy bottles ( each containing 180 ml). 1/3

Liquor bottles were seized and the petitioner was arrested. He further submitted that, apart from this case, petitioner has following previous cases .

1. Crime No. 108 of 2023 registered for the offence under Section 4(1)(a) of TNP Act on the file of Keelamangalam Police Station.

2. Crime No. 257 of 2023 registered for the offence under Section 4(1)(a) of TNP Act on the file of Keelamangalam Police Station..

4. Considering the nature of the offences committed by the petitioner and there are similar previous cases pending against the petitioner and the investigation in this case is not completed, this Court is not inclined to grant bail to the petitioner.

5. Accordingly, this Criminal Original Petition is dismissed. 05.09.2023 Sma 2/3
