This application has been filed by the applicants / plaintiffs seeking leave to sue against the 3rd and 4th respondents / defendants who are residing outside the jurisdiction of this Court.

2. The suit has been filed by the applicants / plaintiffs for declaration to declare that the plaintiffs are the absolute owners for 'B' Schedule property as the plaintiffs developed and enjoyed the property and the defendants do not have any right or claim over the 'B' Schedule property.

3. According to the learned counsel for the applicants / plaintiffs, the suit has been filed for declaration against the defendants. Even though the cause of action is well within the jurisdiction of this Court, the defendants 3 and 4 are residing outside the jurisdiction of this Court. Hence, this leave application is filed.
