Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of mandamus directing the respondent to issue community certificate to the petitioner and his children viz., 1) Liya Sri and (2) Mithun Ranez that they belong to Kurumans community (ST) based upon the proceedings of the State Level Scrutiny Committee passed in favour of the petitioner's relative in Proceedings No.12345/CVIII/2007 dated 09.06.2014.

ORDER

(Order of the Court was made by HULUVADI G.RAMESH, J.) Heard Mr.S.Doraisamy, learned counsel for the petitioner and Mr.P.Karthikeyan, learned Government Advocate representing the respondent.

2. The petitioner, seeks a direction to the respondent to issue community certificate to his children

that they belong to Kurumans community (ST) based upon the proceedings of the State Level Scrutiny Committee, passed in favour of the petitioner's relative in Proceedings No.12345/CVIII/2007 dated 09.06.2014.

3. In the accompanying affidavit filed in support of the Writ Petition, it is stated that the petitioner belongs to Kurumans community, which is classified as Scheduled Tribe Community and his close relative Senthilkumar, was issued with ST Kurumans community certificate by the Revenue Divisional Officer, Dharmapuri, on 17.06.1996. It is further stated that the said certificate of Senthilkumar was verified by the state level scrutiny committee and passed an order on 09.06.2014. Based on the same, the petitioner preferred an application to the respondent on 28.07.2014 requesting to issue community certificate to her children viz., Liya Sri and Mithun Ranez. Since no order is passed by the respondent till date, the petitioner is before this court with the above prayer.

4. Mr.P.Karthikeyan, learned Government Advocate, who was directed to take notice for the respondent, submits that direction may be given to the respondent to do the neeful in this regard.

In the light of the said submission, we direct the respondent to consider the application dated 28.07.2014 preferred by the petitioner and verify the aspects as regards the Community Certificate already issued to the petitioner's relative viz., C.Senthilkumar, which is stated to be verified by State Level Scrutiny Committee by its proceedings No.12345/CVIII/2007 dated 09.06.2014 and do the needful, in accordance with law, within a period of one month from the date of receipt of a copy of this order.

6. The Writ Petition is disposed of with the above direction. No costs.
