Chitrambalam (Died) v. Rathinasabapathy Chettiar (Deceased)

C.M.P.Nos.17446, 17439 & 17448 of 2022 in S.A.No.1485 of 2003 P.T.ASHA, J., The above petitions are filed for the following reliefs:- i. To condone the delay of 1681 days in filing the petition to set aside abatement caused in the above Second Appeal.

ii. To set aside the abatement of the above Second Appeal caused due to the death of respondent herein.

iii. To bring on record, the the respondents 2 to 4 herein as the legal representatives of the deceased respondent and consequently implead them as respondents 2 to 4 in the above Second Appeal.

2. The paper publication has been effected in one issue of "Malai Malar" for indicating the hearing date 11.01.2023. However, today there is no appearance on behalf of the respondents 2 and 3. Therefore, the respondents 2 and 3 are set ex parte and the above petitions are ordered as prayed for. 11.01.2023 shr Note: The Registry is directed to carry out the necessary amendments in the above Second Appeal.
