By consent, the writ petition is taken up for final disposal at the admission stage itself.
The writ petition is filed seeking a direction to the respondents to release the terminal and monetary benefits of the petitioner's husband namely late Mr. K.Eswaran, in favour of the petitioner within a specified time.
The case of the petitioner is that, the petitioner's husband viz., K.Eswaran, retired on 31.05.2008, on attaining the age of superannuation and subsequently died. Since the terminal benefits were not settled, the petitioner has sent representation to the respondents to release the terminal benefits. In the meanwhile, due to rival claimants, the petitioner was constrained to move a civil suit in O.S.No.399 of 2009, before the II Additional District Munsif Court, Salem, wherein, the civil Court has declared the absolute right of the petitioner to get the terminal benefits vide Judgment and Decree dated 04.07.2015. Thereafter, the petitioner has sent numerous representations to the respondents to release the terminal benefits and the last one was sent on
18.01.2023. Based upon the petitioner's representation, the 2nd respondent has forwarded the proposal to the 3rd respondent. However, the 3rd respondent did not take any action. Hence the petitioner has come before this court by way of present writ petition.

Learned Government Advocate appearing on behalf of the respondents would submit that the petitioner's representation will be considered within a reasonable time.

Heard the learned Counsel for the petitioner and the learned Government Advocate for the respondents.

In view of the fair submission made by the learned Government Advocate, without going into the merits of the matter, this Court deems it appropriate to direct the 3rd respondent to consider the petitioner's representation dated 18.01.2023 and pass orders on it's own merits and in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order.
In the result, the Writ Petition is disposed of with the above direction. No costs.
