This Court does not find any infirmity in the observations made by the trial Court, while rejecting the partitioner's application under Section 311 Cr.P.C.

Since the three witnesses namely P.W.1, P.W.4 and P.W.7 were already cross examined in detail and in case the petitioner intends to seek for further cross examination, it would amount to filling up of lacuna.

Hence, there is no merit in the present Criminal Original Petition. Accordingly, this Criminal Original Petition stands dismissed. Consequently, connected Criminal Miscellaneous Petition is also closed.
