C.M.P.No. 20949 of 2023 in C.R.P. SR. No. 97274 of 2023 T.V. THAMILSELVI, J.

This petition has been filed seeking to condone the delay of 10 days in filing the above C.R.P. against the fair and final order dated 31.03.2023 in R.C.A.No.5 of 2022 on the file of learned Rent Control Appellate Authority, Coimbatore.

2. Mr.Krishna Kumar, learned counsel for petitioner submitted that the copy of order was made ready on 26.06.2023. He would submit that due to petitioner's ill-health and on the advise of doctor to take bed rest and also due to unaware of proceedings, he could not instruct his counsel to prefer the above petition in time. In view of the same, there is a delay of 10 days arose in filing the above C.R.P. and the said delay caused is neither willful nor wanton, but for the above said reasons. Accordingly, he has filed the above petition.

3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit is justifiable one. Accordingly, this court is inclined to allow this petition and Registry is directed to number the Civil Revision Petition if it is otherwise found to be in order. 06.10.2023 rpp https://www.mhc.tn.gov.in/judis
