IN THE HIGH COURT OF JUDICATURE AT MADRAS

DATED : 06.08.2025

CORAM

THE HONOURABLE MR. JUSTICE M.NIRMAL KUMAR Crl.MP.No.14660 of 2025 in Crl.OP.No.15264 of 2025 Vivek @ Periyasamy ... Petitioner Vs.

The State by The Sub Inspector of Police, Vettavalam Police Station, Tiruvannamalai District.

(Crime No.44 of 2025) ... Respondent For Petitioner : Mr.A.Murugavel For Respondent : Mr.C.Baskaran, Government Advocate (Crl.Side) **********

O R D E R

The petitioner was granted bail by this Court on 21.05.2025 with the condition that he shall report before the jurisdictional Judicial Magistrate from Monday to Friday at 10:30 a.m., and shall appear before the respondent Police on Saturday and Sunday at 10:30 a.m., until further orders. The petitioner has complied with the said condition but alleges that he has been living in fear, as the rival party has been calling him regularly and he apprehends a life threat. 1/3

2. It is further submitted that, in this case, Kathirvel @ Nadaraj and Manikandan @ Mani, who faced a similar threat, had the condition modified, permitting them to appear before the Inspector of Police, Thallakulam Police Station, daily at 10.30a.m., Madurai. Hence, the petitioner seeks a similar modification to allow him to stay at Madurai and appear before the Thallakulam Police Station.

3. The learned Government Advocate (Crl. Side) strongly opposed the request, submitting that if all the accused are permitted to assemble at one place, there is a possibility of them joining together and committing another offence, which is highly likely. It was further submitted that the petitioner may instead stay at some other distant location.

4. In view of the above, the petitioner is directed to stay at Krishnagiri and appear before the respondent police daily at 10:30 a.m. for a period of 30 days, until further orders. The petitioner is further directed not to leave the limits of the Krishnagiri Town Police Station during the said period of the condition.

5. Accordingly, this Criminal Miscellaneous Petition is ordered. 06.08.2025 To

1. The Sub Inspector of Police, Vettavalam Police Station, Tiruvannamalai District.

2.The Public Prosecutor, High Court of Madras.
