..Respondents Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus or any other appropriate writ, order or direction in the nature of a Writ directing the respondents to Publish/Communicate the NEET-1 result of my son Sanjai Pradeep.S. Vide Roll No.64319401, Registration No.7533557 and thereby permit my son to take part in the Counseling, to be held on 07.10.2016. For Petitioner :

Mr.T.S.Kanmani For Respondents :

Mr.R.Thiagarajan Standing Counsel

ORDER

By consent, the writ petition is taken up for final disposal. The petitioner seeks for a direction upon the respondents to Publish/communicate the NEET-1 result of his son Sanjai Pradeep.S. Vide Roll No.64319401, Registration No.7533557 and thereby permit his son to take part in the Counseling, to be held on 07.10.2016.

Heard the learned counsel for the petitioner and Mr.R.Thiyagarajan, learned Standing Counsel accepting notice on behalf of the respondents.

The relief sought for by the petitioner cannot be granted for the simple reason that when a candidate writes NEET-II examination, his right in respect of NEET-I examination gets automatically extinguished because only after obtaining an undertaking from the candidate that he will not claim any benefit from out of NEETI examination, he is allowed to write NEET-II examination and when such being the position, the petitioner cannot seek declaration of the results of NEET-I examination in respect of his son.

Accordingly, the writ petition stands dismissed. No costs. Consequently, the connected miscellaneous petition is also dismissed.
