Crl.O.P.No.5339 of 2016 K.KALYANASUNDARAM,J., The petitioners, who are arrayed as accused, apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 408, 417 r/w Section 120(b) of IPC, in Crime No.1406 of 2015 on the file of the respondent police and hence, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant transporting cashew nut worth about Rs.33 lakhs from Panruti to Chennai Port for the purpose of exportation, while so, the accused have waylaid the vehicle and committed robbery.

3. The learned counsel appearing for the petitioners would submit that the petitioners are innocent and they have falsely implicated in this case.

4. However, the learned Government Advocate(Crl. Side) submitted that the earlier petitions in Crl.O.P.Nos.25735 and 25736 of 2015 filed by the petitioners were dismissed and the said fact was suppressed by the petitioners.
