ORDER

This writ petition is filed to direct the first respondent to consider the representation of the petitioner dated 29.10.2015 and in turn to direct the second respondent to delete the encumbrance noted in the entry in the book of Register relating to Survey No.98.

2. According to the petitioner, he made a representation dated 29.10.2015 seeking to delete the encumbrance noted against an entry in the respondent's Book of Register against Survey No.98. Further the suit in O.S.No.337 of 2008 filed against the petitioner for partition and separate possession was also dismissed for default. Since there is no response from the respondents, this petition is filed.

3.Heard both sides.

4.Considering the above facts and circumstances of the case, the authority concerned shall consider the representation of the petitioner dated 29.10.2015 in the light of the judgment of the civil court and pass appropriate orders on merits and in accordance with law after giving sufficient opportunity to the petitioner as expeditiously as possible. It is made clear that this court has not expressed any opinion on the merits of the matter. The writ petition is disposed of accordingly. No costs.
