PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of mandamus, directing the 1st respondent to take all necessary action in accordance with law relating to the proceedings in Na.Ka.No.8327/KuVaThoE/A3-1/2024 dated 13.12.2024 arise out of the petitioner's representation dated 07.06.2024 and to deal with the same in a manner known to law.

O R D E R

The petitioner has filed this writ petition seeking a direction to the first respondent to take all necessary action in accordance with law in respect of the proceedings in Na.Ka.No.8327/KuVaThoE/A3-1/2024 dated 13.12.2024, arising out of the petitioner's representation dated 07.06.2024, and to deal with the same in a manner known to law.

The learned counsel for the petitioner submitted that the petitioner had sent her complaint dated 07.06.2024 by post (i) To the Registrar, Madras High Court, (ii) To the District Collector, Chennai, (iii) To the Directorate of Vigilance & Anti-Corruption, and (iv) To one Amudha, I.A.S. Thereafter, the petitioner received a communication dated 26.09.2024, informing her that her complaint had been received by the Directorate of Vigilance and AntiPage No.2 of 8

Corruption on 11.06.2024. Following G.O.Ms.No.173, P&AR (N) Department, dated 19.12.2018, a copy of the complaint was forwarded to the Commissioner of Police, Greater Chennai, and to the Directorate of Prosecution, Chennai. Thereafter, no action was taken. Hence, the petitioner sent a representation dated 26.10.2024. On 11.11.2024, she also addressed a representation to the Commissioner of Police, Chennai, in the name of the (i) Commissioner, (ii) Joint Commissioner, (iii) Deputy CommissionerParthiban, (iv) Assistant Commissioner, and (v) Inspector of R5 Virugambakkam Police Station. The petitioner's complaint dated 07.02.2024 was also forwarded to the Home Department. Thereafter, she sent another representation on 10.02.2025 and subsequently filed the present writ petition.

3. It is seen that the petitioner married one Prabhu Thilaak on 24.10.2007 and that she left her matrimonial home in September 2002. Thereafter, she has been living separately. Her estranged husband, being the son of a former D.G.P., foisted a false case against the petitioner, and Crime No.793 of 2022 was registered by the Virugambakkam Police, in which a charge sheet was filed before the Principal District Court in Spl.SC.No.161 of 2023. Prabhu Thilaak also initiated proceedings in O.P.No.1320 of 2023. Both parties were directed to file their affidavits of assets and liabilities. Page No.3 of 8

The estranged husband, in his statement of assets and liabilities, included the bank statement of his Kotak Mahindra Bank bearing A/c.No.404010045152, wherein he categorically admitted that he paid a sum of Rs.25,000/- to the Special Public Prosecutor, SC/ST, on the ground that he was his friend, through one Mr. Nithiyanandham. The statement of accounts further revealed another transaction of Rs.25,000/- under the remarks "SPL PP Sudhakar" dated 27.02.2024, again routed through Mr. Nithiyanandham.

The petitioner's complaint is that, at the relevant point of time, a case was pending against her, and therefore the said payments can only be construed as bribes and not as amounts legitimately payable to the concerned person. She contends that false reasons have been advanced, and hence she has lodged a complaint against Sudhakar, questioning his credentials of appointment and for receiving the bribe amount, and seeking appropriate action. Hence, the present writ petition.

5. The learned Government Advocate (Crl.Side) submitted that the petitioner's complaint has been forwarded to the Home Secretary and the Commissioner of Police, Chennai, since the complaint makes allegations against the former D.G.P son. The petitioner's representation is currently Page No.4 of 8

being processed and appropriate action is expected to be taken within a period of eight weeks.

6. The learned counsel for the petitioner fairly submitted that the petitioner was tried and acquitted in Spl.SC.No.161 of 2023 by the Principal Sessions Court, Chennai on 17.03.2025.

7. The petitioner contends that the bribe amount, as mentioned in her complaint, has been paid which needs to be investigated, however high a person may be poised or positioned.

Considering the submissions of both sides, this Court finds that steps already initiated in respect of the petitioner's complaint and now the respondent undertakes to complete the enquiry and to take appropriate action within a period of eight weeks. Hence, this Court directs to complete the enquiry and to dispose the petitioner's representation as per law within a period of eight weeks. It is made clear that this order is passed without going into the merits of the complaint.
