O R D E R
Heard the learned counsel appearing for the petitioner, learned Government Advocate (Crl.Side) appearing for the respondents 1 to 3 and the learned counsel for the respondents 4 and 5 and perused the documents placed on record.

The petitioner seeks a direction to grant police protection to conduct the temple festival pursuant to the decree and judgment granted by the learned District Munsif, Panruti in his favour in O.S.No.153 of 2012. The suit has been filed as against 13 defendants to declare that the plaintiff is entitled to perform the 1st day festival of Renukambal Mariyamman Koil, Eripalayam Village and also for permanent injunction. The suit has been decreed in favour of the petitioner as early as on 24.06.2014. Further, permanent decree is also granted in favour of the petitioner.
3. Now the respondents 4 and 5 claim that they are entitled to have first day pooja. According to them, they also filed a suit in O.S.No.141 of 2015. Page 2 / 4

In such view of the matter, mere pendency of the suit will not bind the petitioner any where, whereas the petitioner's right has been already crystalised in a decree and judgment in O.S.No.153 of 2012. The Judgment passed by the Civil Court has to be respected and admittedly the permanent injunction is also in favour of the petitioner. Further, to enforce the decree of permanent injunction, there is no limitation, it can be enforced at any time.
5. Accordingly the 1st respondent / police shall give necessary police protection to the petitioner to conduct the first day festival at any time. In the result, the present Petition is allowed. No costs. 22.08.2025 Index : Yes / No Internet : Yes / No Speaking Order / Non Speaking Order ssd To
