Respondent Prayer: The Transfer Civil Miscellaneous Petition is filed under Section 24(1) of the Code of Civil Procedure, seeking to transfer the case in G.W.O.P.No. 64 of 2024 on the file of the District and Sessions Judge at Thirupathur District and transfer the same to the District and Session Court at Vellore District.

ORDER

Heard the learned counsel appearing for the parties.

2. The learned counsel for the respondent fairly submits that, in view of the pendency of connected proceedings before the District and Session Court, Vellore, the respondent has no objection to the transfer of the Guardian O.P. in G.W.O.P. No. 64 of 2024 from the file of the District and Sessions

Court, Thirupathur, to the file of the District and Session Court, Vellore.

3. I have gone through the affidavit filed in support of the petition. The petitioner has assigned genuine and acceptable reasons for being unable to attend the hearings at Thirupathur.

4. In view of the above, this Court is of the opinion that the petitioner has made out a case for transfer of the suit, as prayed for.

5. Accordingly, the Tr. C.M.P. No.926 of 2024 is allowed and Guardian O.P. in G.W.O.P. No. 64 of 2024 pending on the file of District and Sessions Court, Thirupathur is withdrawn and transferred to the file of the District and Sessions Court, Vellore District.

6. The District and Sessions Court, Thirupathur is directed to send the entire records relating to G.W.O.P.No.64 of 2024 to the District and Sessions Court, Vellore forthwith.

7. The District and Sessions Court, Vellore is directed to take up the G.W.O.P.No. 64 of 2024 and dispose of the same expeditiously, in a manner

known to law. No costs. Consequently, connected miscellaneous petition is closed.
