ORDER
Pursuant to my order dated 25.07.2025, the learned IV Additional District Judge, Coimbatore, in Do.753/2025 dated 02.08.2025, has stated that the 5th defendant has taken out an application for rejection of the plaint under Order VII Rule 11 of CPC and the same is being taken up for enquiry 1/4
on 08.08.2025 and the learned Judge has sought for one month time to dispose of the said application for rejection of the plaint. 2.The learned counsel for the petitioner states that insofar the suit, despite service of summons and undertaking by some of the counsel who represent the served defendants, even vakalat has not been filed and even at the stage of service of summons, the matter is being protracted. 3.However, considering the fact that the application for rejection of plaint is being taken up first, a direction is issued to the IV Additional District Judge, Coimbatore to dispose of the said application for rejection of plaint filed by the 5th defendant, within a period of four weeks from the date of receipt of a copy of this order.
Subject to the decision in the said order VII Rule 11 of CPC application and if the Trial Court comes to the conclusion that the suit has to be tried and the application for rejection of plaint is not maintainable, then the Trial Court shall expedite completion of pleadings, within a period of eight weeks from the date of receipt of a copy of this order and shall thereafter frame issues, within a period of one week from the date of the pleadings being complete.

4.With the above direction, the Civil Revision Petition is allowed. There shall be no order as to costs.
