C.M.P.Nos. 9310, 9311, 9312 of 2017 in S.A. No. 249 of 2015 T.V. THAMILSELVI, J.

These petitions are filed seeking to condone the delay of 530 days in setting aside the abatement, to set aside the abatement caused due to the death of 4th respondent, and to bring on record the proposed respondents 14 to 16 herein as legal representatives of deceased 4th respondent.

2. Mr. K.Thangavelu, learned counsel for petitioner/appellant submitted that pending appeal, 4th respondent died on 28.07.2015. Hence, he has filed the above petitions.

3. Mr.T.P.Prabakaran, learned counsel appearing for the respondents 1,6 and 8 appeared and raised his objections.

4. Considering the facts and circumstances, and being satisfied with the reasons assigned in the affidavit, all the petitions are allowed on payment of cost of Rs.2000/- payable to the contesting respondents 1, 6 and 8 on or before 11.07.2022. The proposed legal representatives of the 4th respondent are impleaded as respondents 14 to 16 in the above Second Appeal.
