The application has been filed seeking to condone the delay of 162 days in filing the written statement by the 2nd defendant.
2. The suit had been filed seeking recovery of money together with interest claimed as against both the 1st and 2nd defendants.
3. The 1st defendant had already filed the written statement.
4. In view of the fact that the pleadings are required to adjudicate the claims made by the plaintiff and also to examine the issues raised by the defendants, the application stands allowed.
5. However, if at all, there is a decree in favour of the plaintiff, after conclusion of trial for the delay of 5 months, the Court shall grant one additional percentage of interest, to the interest already granted.
6. With the above observation, the application stands allowed. The written statement of the 2nd defendant is taken on record. 27.10.2022 (1/2) ssi 1/2
