This criminal original petition has been filed challenging the order passed by the court below dismissing the application filed by the petitioner under Section 311 of Cr.P.C., to recall PW1 for cross examination. 1/4

2.Heard the learned counsel for the petitioner and also carefully perused the materials available on record.

3.It is seen from records that calendar case is of the year 2012 and it is 11 years, since there has been absolutely no progress in this case. The court below has recorded sufficient reasons for dismissing the application and this Court does not find any illegality or infirmity in the order passed by the Court below and it does not require the interference of this Court. This Court does not find any merits in this case. 4.Accordingly this criminal original petition stands dismissed. Consequently, connected miscellaneous petition is closed.
