ORDER
This Writ Petition has been filed seeking for Police protection in order to celebrate the festival on 05.09.2023 based on the representation made by the petitioner on 26.08.2023.
2. Heard Mr.R.Sankarasubbu, learned Counsel for the petitioner and Mr.A.Damodaran, learned Additional Public Prosecutor for the respondents 1 to 3.
3. It is seen from records that there was already a dispute between the parties and the same was considered by the Tahsildar, Madavaram in a Peace Committee meeting and a decision was arrived at in this regard on 25.07.2018. As per the said decision, each party was specifically allowed to perform their part during the festival. The learned Counsel for the petitioner submitted that this is continued without fail even during the subsequent 2/4
years. Accordingly, the B-party has already completed their part of the function on 08.08.2023 and the A-party will have to conduct their part in the festival on 05.09.2023.
4. In the considered view of this Court, there is already an arrangement made by the Tahsildar through proceedings, dated 25.07.2018 and the same has to be properly adhered to. Hence, the respondent Police shall ensure that the festival goes on peacefully on 05.09.2023 without any law and order problem. The respondent Police shall ensure that the earlier understanding is properly followed.
5. This Writ Petition is disposed off in the above terms. No costs. Consequently, connected miscellaneous petition is closed. 01.09.2023 Index : yes/no Speaking order/Non-speaking order : yes/no grs Note : Issue order copy today.
