This petition is filed under Section 378 (4) Cr.P.C, to grant leave to file an appeal against the order of acquittal dated 03.07.2023 made in S.T.C.No.311 of 2021 on the file of the learned Judicial Magistrate, Fast Track Court, Poonamallee.

2. Heard Mr.A.Thirumaran, learned counsel for the petitioner.

3. Learned counsel for the petitioner contended that though the accused did not deny his signature on the cheque, the trial court had acquitted the accused based on the contention of the accused that he had settled an amount of Rs.35,000/- prior to the issuance of the cheque by him in favour of the complainant.
