The Petitioner, who apprehends arrest at the hands of the Respondent police for the offence punishable under Section 4(1)(a), 4(1-A) & 4(1)(h) of TN Prohibition Act in Crime No.252 of 2023 on the file of the Respondent police, seeks anticipatory bail.

2.The case of the prosecution is that when the Respondent Police on patrol duty, they found A2 & A3 in possession of 20 litres of ID arrack and 10 nos of 180 ml golden choice brandy. Based on the confession statement of A2 it was found that the Petitioner had arranged A2 & A3 for selling ID arrack. Hence the complaint.

3.Learned counsel for the Petitioner would submit that the Petitioner was falsely implicated in this case, on the confession statement of the coaccused and this is the second anticipatory bail petition and the first one was already dismissed by this Court in Crl.OP.No.14521 of 2023 dated 30.06.2023. 4.Heard the learned counsel for the Petitioner and the learned 1/ 3

Government Advocate (Crl. Side) appearing for the Respondent Police. 5.Taking into consideration the facts and the submissions made by the learned counsel on either sides and the fact that there is no change of circumstances, I am not inclined to grant anticipatory bail to the Petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. 19.09.2023 sai 2/ 3
