decreed, the first appeal filed by the fourth respondent was allowed and thereafter the second appeal filed by the petitioner is pending before this Court.

In view of the aforesaid position, the respondent/authorities do not really come into the picture, as the civil rights of the parties will be decided in the second appeal.
